Please read these Terms of Service ("Terms") carefully before using Itinera Planner (the "Service") operated by Itinera Planner ("us", "we", or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you do not have permission to access the Service.
Itinera Planner is a software-as-a-service (SaaS) platform that enables travel agencies to create and deploy AI-powered chat agents. These agents assist with customer inquiries using information provided by agency users.
To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must be at least 18 years old to use this Service.
We offer the following subscription plans:
Subscriptions are billed in advance on a recurring monthly or annual basis. All prices are in EUR and exclude applicable taxes (VAT).
You authorize us to charge your payment method for the subscription fees. If payment fails, we may suspend your access until payment is received.
Each subscription plan includes a monthly allocation of AI tokens. Token usage is measured based on the length and complexity of conversations processed by your agents.
Fair Use Policy: The Service is intended for legitimate business use by travel agencies. You agree not to:
We reserve the right to suspend accounts that violate fair use policies or exhibit abnormal usage patterns.
The AI agents provided through this Service are tools to assist with customer communication, not replacements for human judgment.
You acknowledge and agree that:
We are not liable for any decisions made based on AI-generated responses or for any business losses resulting from AI inaccuracies.
You retain ownership of all content you provide to configure your agents ("Your Content"), including business information, tour descriptions, and custom prompts.

You grant us a limited license to use Your Content solely to provide the Service.

To the maximum extent permitted by law, Itinera Planner and its affiliates shall not be liable for:
Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
These limitations apply regardless of the legal theory (contract, tort, or otherwise) and even if we have been advised of the possibility of such damages.
You agree to indemnify and hold harmless Itinera Planner, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, Your Content, or your violation of these Terms.
By You: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.
By Us: We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or fail to pay subscription fees. We may also discontinue the Service with 30 days' notice.
Upon termination, your right to use the Service ceases immediately. We may delete your data 30 days after termination unless legally required to retain it.
Refunds are handled on a case-by-case basis at our discretion. Generally, we do not provide refunds for partial subscription periods. If you believe you are entitled to a refund, contact us at support@saasykit.com.
We may modify these Terms at any time. We will provide at least 30 days' notice for material changes. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
These Terms are governed by the laws of the Republic of Croatia, without regard to conflict of law principles. For EU consumers, mandatory consumer protection laws of your country of residence also apply.
Informal Resolution: Before initiating formal proceedings, you agree to contact us at support@saasykit.com and attempt to resolve the dispute informally for at least 30 days.
Mediation: If informal resolution fails, the parties agree to attempt mediation before proceeding to litigation.
Jurisdiction: Any disputes that cannot be resolved through mediation shall be submitted to the competent courts in Croatia. EU consumers may also bring claims in the courts of their country of residence.
EU consumers may also use the European Commission's Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr
Entire Agreement: These Terms, together with our Privacy Policy and AI Transparency Policy, constitute the entire agreement between you and Itinera Planner.
Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
Waiver: Failure to enforce any right does not constitute a waiver of that right.
